Nondischargeable Debt

Some debts simply cannot get discharged in a bankruptcy proceeding. This nondischargeable debt includes:

Student loans
Some tax debt
Customs debts
Child or spousal support
Some personal injury judgments
Debt related to fraud committed by the debtor

An Example for Context

Blake and Crystal* have serious financial problems for a number of reasons. Blake is a life-long learner and has accrued $80,000 in student loan debt. Blake and Crystal were particularly concerned about paying off that debt when, out of the blue, Blake was diagnosed with a serious disease. He had substantial medical bills and the couple paid for them with credit cards, accruing $120,000 in debt. In addition to the student loan and medical debt, Blake was married previously and pays child support in the amount of $300 per month to support his two children. If Blake and Crystal want to file for bankruptcy, the student loan debt and the child support are nondischargeable debt. However, the medical debt could be wiped away if Blake and Crystal met the requirements for a Chapter 7 bankruptcy. However, under federal bankruptcy, in some cases a debt that was once nondischargeable can be made dischargeable by showing a serious and debilitating hardship.
