Bankruptcy Basics

Below is a general idea of what you can expect from the bankruptcy process:

Filing the petition: Filing for bankruptcy enacts an automatic stay — a legal injunction that protects you from creditor actions such as harassment, foreclosure and wage garnishment.
The 341 meeting: In 20-40 days after filing, you will attend this meeting with your bankruptcy trustee. This is also known as the creditor meeting because your creditors are invited to come, although they typically do not.
Chapter 7 debt discharge: In about two months after filing, your debt will be discharged.
Chapter 13 payment plan: After establishing a payment plan with the trustee, you will enter into a three to five year payment plan. If circumstances affect your ability to keep up with that payment plan, it is important to contact your bankruptcy attorney right away.
